Heard the learned Counsel for the applicant and Shri Faldessai, the learned Additional Public Prosecutor for the respondent no.2. None appears for the respondent no.1, though served.

2. This is an application for suspension of sentence.

3. The applicant has been convicted for the offence punishable under Section 138 of the Negotiable Instruments Act (the Act, for short) and has been sentenced to pay fine of Rs.50,000/- and in default, to suffer Simple Imprisonment for 30 days. It is submitted that Rs.43,000/- are deposited before this Court and Rs.7,000/- are deposited before the learned Sessions Judge. In that view of the matter, the substantive sentence is hereby

CRMA/49/2018 suspended.

4. Hearing of the Criminal Revision Application is expedited.

5. The application is disposed of.
