Attorney of the petitioner, based on the express instructions from the petitioner has filed an affidavit dated 16.03.2024. In the affidavit, it is stated that the petitioner will positively arrive in Goa-India on 18.06.2024. Mr Gaonker, based on instructions from the petitioner also states that the petitioner will positively come to Goa on 18.06.2024. 2.
Mr Gaonker states that the look-out circular which was challenged in this petition had a validity of one year. He refers to the Office Memorandum (OM) dated 27.10.2010 issued by the Government of India in this regard. In particular, he refers to paragraph 2 of this OM which states that if the look-out circular is not validated for further periods, the same would be considered to be valid only for a period of one year from the date of its issue and watch would be maintained by the person concerned at the immigration check posts only for that period. 18th March, 2024

Based on the above, and on the expression instructions from the petitioner, Mr Gaonker seeks leave to withdraw this petition with liberty to challenge any further look-out circulars that might be issued against the petitioner.

Accordingly, we accept the petitioner's statement about his returning to Goa-India on 18.06.2024 and further, grant the petitioner leave to withdraw this petition with liberty as prayed for. 5.
Tis petition is accordingly disposed of with liberty as prayed for. Tere shall be no order for costs.
