Heard Mr. V. Menezes, learned Counsel appearing for the applicant and Mr. G. Kanekar, learned Counsel appearing for the respondents No.1(b) and 1(c).

2. This is an application for condonation of delay of 42 days in filing an appeal. The respondents have filed their reply, opposing the said application for condonation of delay.

3. Considering that the averments made in the application are supported by an affidavit, which have not been controverted by the

MCA/210/2015 respondents by filing any affidavit disputing the said contents, we find that there is a sufficient cause shown by the applicant for condoning the delay.

4. Hence, the application stands, accordingly, allowed. The delay of 42 days stands condoned. The application is disposed of accordingly.
