After the matter is heard at some length, learned Counsel for the petitioner seeks leave to withdraw the petition, upon the instructions of the sole petitioner, who is present in Court, with liberty to urge the contentions raised in the present petition in the pending criminal prosecution. 3.

The petition is dismissed as withdrawn with liberty as prayed. We make it clear that we have not applied our minds to
