1. Heard Mr. J.J. Mulgaonkar, learned Counsel for the applicant and Mr. Milton Marshal, learned Counsel for respondent Nos.1 and 3.

2. Vide order dated 12/09/2023, condition was put on the applicant to deposit an amount of Rs.25,000/- in accordance with Section 173 of Motor Vehicles Act and 50% of the awarded amount for grant of stay to the award.

3. Mr. Mulgaonkar now submits that the amount of Rs.25,000/- is deposited. However, the applicant is unable to deposit 50% of the amount awarded by the Tribunal.

4. In view of the above statement, conditional stay granted to the award shall not operate as the applicant has failed to deposit 50% of the awarded amount.
