IN THE HIGH COURT OF BOMBAY AT GOA

CRIMINAL REVISION APPLICATION NO. 13 OF 2016 SHRI. SUBHASH PAWASKAR.

... Petitioner

Versus

STATE REPRESENTED BY THE PP AND ANR.

... Respondent Adv. S. Shet for the Petitioner.

Mr. M. Amonkar, Addl. Public Prosecutor for the Respondents. Coram:- C. V. BHADANG, J.

Date:- 22nd June, 2016 P.C.:

By this revision application, the petitioner is challenging the order dated 15/12/2015 by which the learned Children's Court has framed a charge against the petitioner for the offence punishable under section 323 of I.P.C r/w section 2(m)(i) and (ii) punishable under section 8(2) of the Goa Children's Act, 2003. On hearing the learned counsel for the petitioner and the learned Addl. Public Prosecutor for the respondent/State, I do not find that any case for interference is made out. The Children's Court has considered the statement of the victim boy, who was aged 13 years and 6 months on the date of the incident i.e. on 31/8/2013. Apart from the statement of the victim, there are statements of one Saish Naik and one Mr. Gerson, who was the Physical Instruction teacher in the school about the assault on the victim. In such circumstances, in view of the material available on record a case for framing of charge is clearly

CRIR/13/2016 made out. The criminal revision application is without any merit and is hereby dismissed.
