The Petitioner, by this Petition under Article 226 of the Constitution of India, prays for a writ of mandamus, commanding respondents No.1 to 8 to shut down the industry run by Respondents No.12 and 13 and to direct them to cease all industrial activities and operations within the premises described in the prayer clause (a) of the Petition.

The learned Additional Govt. Advocate for Respondents No.1,2,5 to 11 tenders a copy of the letter dated 22/03/2017 from the Labour Inspector (Engg.) addressed to the Occupier/Manager i.e. Respondents No.12 and 13, directing them to comply with various requirements to process the application for renewal of the factory

2 wp273-10dt.27-3-19 licence. The learned Additional Govt. Advocate states that till date no such requirements set out in the said letter are met by Respondents No.12 and 13 and, thus, the factory licence has not been renewed by the authorities since 2016. The statement is accepted.

The said letter is taken on record.

In our view, in view of the aforesaid position, nothing survives in this writ petition. The Writ Petition is, accordingly, disposed of. If Respondents No.12 and 13 press for renewal of the licence again, the Licensing Authority shall not issue such licence without hearing the Petitioner.

There shall be no order as to costs.
