While allowing the Second Appeal, this Court has formulated two substantial questions of law mentioned in the order dated 25/03/2015. Subsequently, this Court has granted interim relief which is in force till today.

2. I have heard Shri R. Menezes, the learned Counsel appearing for the applicants. Respondent no.1, who appears in person is absent today. Respondent no.2 died during the pendency of the suit in the Trial Court and as such the suit was dismissed against him by an order dated 5/09/2009.

3. The interim relief granted by this Court by order dated

CA/36/2015 27/07/2015 and continued by the order dated 6/10/2015, to continue till the disposal of the appeal.

4. Civil application stands disposed of.
