Heard Mr. D. Pangam, learned Counsel appearing for the applicant and Mr. P. Faldessai, learned Additional Govt. Advocate appearing for the respondent.

2. This is an application to disburse the amount payable to the applicant/respondent in the original appeal in terms of the Judgment passed by this Court dated 18/02/2015 while disposing of First Appeal No.44/2008.

3. Mr. P. Faldessai, learned Additional Govt. Advocate, upon instructions of the concerned Official, has pointed out that no appeal has been preferred against such Judgment. It is also pointed out that

MCA/251/2016 the amounts in terms of the impugned Judgment have been deposited with the Registry of this Court.

4. Hence, we dispose of the above application by directing the Registry of this Court to make a payment of an amount of Rs.4,49,126=37 and a sum of Rs. 24,98,522=00, along with interest at the rate of 10% per annum from the date of filing of the suit, upto actual payment of such amounts to the applicant/respondent to the original appeal. Surplus amount deposited, if any, in this Court, along with interest accrued thereon shall be refunded to the original appellant/respondent herein.
