Parties through their Counsel.
2. Challenging the order dated 31/01/2018 passed by the Inspector General of Prisons, Panaji, Goa to the extent by which he has been asked to execute a bail bond in the sum of Rs.1,00,000/- and produce one surety in the like amount giving cash or otherwise, for releasing him on furlough for a period of 14 days, the petitioner has filed this petition.
3. According to the petitioner, the condition to execute a bail bond in the sum of Rs.1,00,000/- and produce one surety in
WPCR/41/2018 the like amount giving cash or otherwise is too harsh. He submits that it would be impossible for the petitioner to get the benefit of the order of furlough because of such stringent condition. He submits that if the bond amount is not ordered to be reduced, he will not be able to enjoy the fruits of the order.
4. Having considered the submissions of the learned Counsel for the petitioner, as also the learned Public Prosecutor, in the interest of justice, we deem it appropriate to modify the condition of the order to the extent that the petitioner shall execute a personal bond in Form II for a sum of Rs.10,000/- and produce one surety in the like amount giving cash or otherwise.
5. The impugned order is modified to the said extent only.
6. The petition stands disposed of accordingly. NUTAN D. SARDESSAI, J.
