On hearing the learned Counsel for the parties, the appeal is disposed of, by consent of parties, in the following terms: (a) The appellant nos. 1 to 3 shall continue to operate the business in the suit property no. 1 i.e. M/s Happy Home Medical Stores, subject to final decision of the Civil Suit No. 45/2011, pending before the learned District Judge at Panaji. (b) The appellant nos. 1 to 3 shall not create any third party rights or encumbrance on the suit property no. 1, pending disposal of the aforesaid suit.

(c) The rival contentions of the parties, on merits, are left open. (d) The impugned order dated 15.01.2016 shall stand modified in the aforesaid terms.
