1. By the self-operative order dated 17th August 2023, this Petition is already dismissed as against Respondent No.2. Te matter was kept on board to see whether the Petition survives against Respondent No.1.

2. Mr P. Naik points out that Respondent No.1-Candido Sebastiao Francisco Fernandes had filed an application for purchase of the mundkarial house from Respondent No.2 (bhatkar). Te Petitioners had applied for intervention, claiming that even they have rights in the mundkarial house.

3. Now that this Petition is abated as against the LRs of the bhatkar i.e. Respondent No.2, the same will not survive qua Respondent No.1.

4. Accordingly, this Petition is dismissed. Tere shall be no order for costs.
