As against the impugned order an appeal lies under section 82 of the Employees State Insurance Act 1948. Accordingly, Mr. De Sa seeks leave to withdraw this petition with liberty to institute an appeal.

2. Leave is granted with liberty as applied for. If the appeal is instituted within a period of 15 days from today, the petitioner will be able to contend that this petition was lodged and pursued bona fide in order to challenge the impugned order.

3. The petitioner is permitted to take back the certified copy of the impugned order by replacing the same with a true copy of the impugned order.
