This application seeks extension of time to deposit amount of Rs.6.50 lakhs as directed by the order of this Court dated 16/01/2015.
2. This Court while disposing of the Writ Petition and restoring the matter to the Trial Judge had directed the defendants to deposit the amount related to disputed transaction amounting to Rs.6.50 lakhs before the Trial Court. On deposit the same was directed to be invested in Fixed Deposit enuring to the benefit of the successful party.
3. The present applicant seeks extension of time to deposit the amount by 8 weeks for the reason that its Director concerned has been ailing for sometime and was thus not able to organise funds to
MCA/167/2015 comply with the directions of this Court. Besides, it is pointed out that the transaction related to Deed of Sale of 19/05/2004 and funds are not readily available with the applicants.
4. Mr. Silva, learned Counsel for the respondents opposes the application.
5. The reason set out in the application appears to be bonafide. Thus time is extended by a period of six weeks from the date of the application i.e. 4 March 2015.
6. In view of the above, the Civil Application is allowed to the extent the time to deposit the amount of Rs.6.50 lakhs is extended by a period of 6 weeks from 4/03/2015 i.e. up to 15/04/2015.
