Heard Mr. Sardessai, the learned counsel for the petitioners.

2. This Court by an order dated 7/1/2014 passed in Writ Petition No.437/2013 had directed the Assistant Registrar to take on record the rejoinder dated 15/5/2007, to conduct inquiry as directed by this Court by the order dated 25/9/2006 passed in Writ Petition NO.389/2006, in terms of Section 21 of the Maharashtra Co operative Societies Act, as applicable to Goa and to decide the matter of de-registration within a period of 11 months.

3. The Assistant Registrar has passed an order on 23/10/2014 which is within a period of 11 months. However, what is contended is that no inquiry was conducted by the Assistant Registrar as directed and

CPM/12/2015 that is, in the nature of contempt.

4. The learned counsel for the petitioner submitted that the petitioners have challenged the order dated 23/10/2014 by way of a separate petition no. W.P. No.154/2015 and in that view of the matter, the learned counsel on instructions, seeks permission to withdraw the petition. The contempt petition is yet to be admitted. In such circumstances, the petition is dismissed as withdrawn. It is needless to mention that the contentions on merits are kept open. C. V. BHADANG, J.
