Heard Shri A.F. Naik, learned Counsel appearing for the petitioner, Shri S.D. Lotlikar, learned Advocate General appearing for the respondents no.1 & 2 and Shri P.S. Rao, learned Counsel appearing for the respondent no.5.
2. The challenge in the above petition is to the meeting convened to decide on a no confidence motion requisitioned by the respondent no.3. Such requisition was directed pursuant to an order dated 9/02/2017 while disposing off the Writ Petition No.113 of 2017.
3. Though Shri A.F. Naik, learned Counsel appearing for the petitioner has raised various contentions with regard to the
WP/205/2017 propriety, legality and correctness of the decision taken by the concerned Registrar to requisition such meeting, we find that the question of any interference at this stage in convening the meeting in terms of Section 59-A(3) of the Co-operative Societies Act, 2001 would not at all be justified. Keeping all the contentions of all the parties open to be examined in an appropriate forum, we dispose off the above petition. Petition stands accordingly disposed off.
