Taking into consideration the fact that the Petitioner has an alternate and efficacious remedy available to them before the Debt Recovery Tribunal (DRT), we do not think that it would be appropriate for us to interfere in this matter. 3.

This is more so in view of the decisions of the Hon'ble Apex Court in Authorized Officer, State Bank of Travancore & Ors. Vs. Matthew K.C. [2018 All SCR 700] and of this Court in Kotak Mahindra Bank Ltd. and ors. vs. State of Maharashtra [2018 (4) All MR 37).

Accordingly, this Petition is dismissed. However, liberty is granted to the Petitioner to avail of an alternate remedy before the DRT. All contentions of all parties are expressly left open. Nutan D. Sardessai, J. M.S. Sonak, J.
