1. The Petitioner preferred a complaint to the Village Panchayat of Cortalim Goa, in regards to the illegal construction in form of a four storey building and prayed for initiation of action under Section 66 of the Goa Panchayat Raj Act, 1974, for its demolition. Pursuant to the said complaint being made, a site inspection was scheduled by the Village Panchayat on 10.11.2023 but the report record that Respondent is not allowing the inspection and indulging in argument and therefore, the inspection was kept on hold. Similarly, it is also recorded that they refused to sign the inspection proceedings and also the notice.

Today, Mr Prasheen Lotlikar, the learned Counsel on instructions from Respondent No.4, fairly state that his client has no objection if the inspection is carried out by the Village Panchayat and he shall render cooperation in carrying out the site inspection. By recording the statement made by the learned Counsel in that regard, we direct Village Panchayat Cortalim to take such steps as are necessary for inquiring into the complaint preferred by the Petitioner on 03.10.2023 under Section 66 of the Goa Panchayat Raj Act, which would include carrying out inspection, issuance of notice and taking the proceedings to its logical end.

3. In the wake of the aforesaid, we deem it appropriate to dispose of the Petition as we have recorded the statement made by the learned Counsel, on instructions from Respondent No.4, that all cooperation shall be rendered to the Panchayat, and we expect the Panchayat to inquire into the complaint and take steps in accordance with law. With the aforesaid directions, the Petition is disposed of. NIVEDITA P. MEHTA, J.
