ORAL JUDGMENT After hearing the matter for sometime, both the learned Counsels sought time to explore the possibility of arriving at settlement as dispute is essentially a matrimonial dispute. The petitioner as well as the respondent were also present in Court. After discussion between the both the learned Counsels in the presence of both the parties it was pointed out that the parties have amicably settled their dispute with regard to the above petition on terms specified herein below.

As such, the following order is passed by consent of the
learned Counsels as well the respective petitioner and the respondent.
O R D E R
(i) The impugned judgment dated 27.1.2011 passed in Regular Civil Suit No.17/2010/A(N) is quashed and set aside.
(ii) The respondent is entitled to withdraw the total amount deposited by the petitioner in terms of the order dated 5.4.2011 alongwith accrued interest thereon, if any. (iii) Registry is accordingly directed to permit the respondent to withdraw the total amount deposited pursuant to the said order dated 5.4.2011 alongwith interest accrued thereon, if any.
(iv) All the contentions of both the parties in respect of their respective claims to the property or otherwise are left open.
(v) Petition stands disposed off accordingly. F. M. REIS, J.
