This is an application for injunction restraining the respondent no.2 from carrying out mutation in the survey records and from creating third party rights in the suit property and construction.

2. On hearing the learned counsel for the parties it appears that a similar injunction was operating during the pendency of the suit. The first appeal is already admitted. The learned counsel for the respondents in all fairness states that the respondents have no interest of carrying out any construction or creating any third party interest in the suit property. In that view of the matter and further having regard to the fact that a similar injunction was

CA/54/2017 operating during the pendency of the suit, the application is allowed in terms of prayer clauses (a) (b) and (c).
