Though several attempts have been made to ensure the presence of the Respondent Cooperative Bank, none appear despite having been served. Considering that the Applicant has now made the entire payment of compensation and has deposited the penalty amount, the Applicant stands acquitted of the offence under Section 138 of the N.I. Act of which he was convicted by order dated 16.11.2022 of the J.M.F.C. at Ponda in Criminal Case No. 475/OA/NIA/2018/B.
