IN THE HIGH COURT OF BOMBAY AT GOA

WRIT PETITION NO. 222 OF 2016 SHRI. NANDA S. RAIKAR AND 5 ORS., ... Petitioners

Versus

THE CAPTAIN OF PORTS, GOVERNMENT OF GOA AND ANR., ... Respondents Mr. Joaquim Godinho, Advocate for the petitioners. Mr. Sagar Dhargalkar, Additional Govt. Advocate for the respondents.

Coram:- F. M. REIS & K. L. WADANE, JJ.

Date:- 24th February, 2016 P.C.:

Heard Mr. J. Godinho, learned Counsel appearing for the petitioner and Mr. S. Dhargalkar, learned Additional Government Advocate for the respondents.

2. Upon hearing the learned Counsel, the main grievance of Mr. J. Godinho, learned Counsel appearing for the petitioner appears to be at this stage that though the auction process of the fishing stakes in the subject land was initiated in the year 2014, such auction process has not yet been completed. On the other hand, Mr. S. Dhargalkar, learned Additional Govt. Advocate points out that though one stake was auctioned, the remaining could not be auctioned as, according to him, there were some objections raised with that regard. However, Mr. J. Godinho, learned Counsel

WP/222/2016 appearing for the petitioners submits that the question of entertaining such objections at this stage does not arise at all. But, however, it is pointed by the learned Additional Govt. Advocate that site inspection is fixed on 26th February, 2016 and notice has already been given to the concerned parties.

3. The learned Additional Govt. Advocate, upon instructions, states that the auction process will be completed within two weeks from today.

4. With out going into the rival contentions whether such objections can be examined or not at this stage, we dispose of the above writ petition by directing the respondent No.2 to complete the auction process initiated on 22nd October, 2014, as expeditiously as possible, and in any event, on or before 31st March, 2016, in accordance with law.

5. The petition stands disposed of in the above terms. K. L. WADANE, J.
