Shri Diago M. Moura. v. Shri V.S. Nair Office Of The Official Liquidator.
IN THE HIGH COURT OF BOMBAY AT GOA
CONTEMPT PETITION NO. 9 OF 2016 IN COMPANY APPEAL NO. 2 OF 2010 SHRI DIAGO M. MOURA.
... Petitioner
Versus
SHRI V.S. NAIR OFFICE OF THE OFFICIAL LIQUIDATOR.
... Respondent Mr. Kaif Noorani, Advocate for the petitioner. Ms. Amira Razaq, Advocate for the Official Liquidator. Coram:- F. M. REIS, J.
Date:- 11th March, 2016 P.C.:
Heard Mr. K. Noorani, learned Counsel appearing for the petitioner and Ms. A. Razaq, learned Counsel appearing for the Official Liquidator.
2. The above petition has been filed on the premise that though a direction was issued by this Court on 18th March, 2011 at the time of remanding the matter to the Official Liquidator, to decide the claim within four weeks, no compliance with that regard was effected by the Official Liquidator. But, however, the learned Counsel appearing for the Official Liquidator submitted that a Report was filed way back on 11th August, 2011 for extension of time, but, however, by oversight the application was placed in the
CP/9/2016 wrong Company Appeal No.2/2011. The learned Counsel, as such, points out that for the reasons stated in the said application, the orders could not be complied with within the time stipulated.
3. This Court does not appreciate the conduct of the Official Liquidator in filing an application which was placed in the wrong file. No steps were taken to verify whether any orders were obtained from this Court for extension of time. But, however, without going further into the matter, the above contempt petition stands disposed of by directing the Official Liquidator to comply with the directions of this Court in the said Order dated 18th March, 2011 as expeditiously as possible, in any event, within two weeks from today. As such, the Report of the Liquidator dated 11th August, 2011 which was placed on the file of Company Appeal No.2/2011 is ordered to be placed in the above contempt petition.
4. The contempt petition stands disposed of accordingly. F. M. REIS, J.
