(i) The appeal is partly allowed.

(ii) The conviction of the appellant for the offence punishable under section 302 of I.P.C. is modified to one under section 304 Part II of I.P.C.

(iii) The appellant is sentenced to suffer imprisonment for the period already undergone and to pay a fine of Rs.10,000/- (Rupees ten thousand only) and in default to suffer simple imprisonment for one month.

(iv) The appellant shall be set at liberty on deposit of the fine

CRIA/22/2015 (if not already deposited) and if not required in connection with any other offence.

(v) The order as regards disposal of the property is hereby maintained.
