This is an application for suspension of sentence. The applicant has been convicted for the offences punishable under Sections 120-B, 420, 467, 468 and 471 of the Indian Penal Code read with Sections 13(1)(d) and 13(2) of the Prevention of Corruption Act, 1988.
2. For the offence punishable under Section 120-B of the Indian Penal Code, the applicant is sentenced to suffer imprisonment for a period of two years and to pay a fine of Rs.25,000/- and in default to suffer simple imprisonment for a period of three months.
For the offence punishable under Section 420 read with 120-B of the Indian Penal Code, the applicant is sentenced to suffer
CRMA/89/2017 imprisonment for a period of one year and to pay a fine of Rs.10,000/- and in default to suffer simple imprisonment for a period of one month.
Similar is the sentence in respect of the offences punishable under Section 467, 468 and 471 of the Indian Penal Code. For the offence punishable under Section 13(1)(d) read with 13(2) of Prevention of Corruption Act, the applicant has been sentenced to suffer imprisonment for a period of two years and a fine of Rs.25,000/- and in default to suffer simple imprisonment for a period of three months.
The substantive sentences have been directed to run concurrently. The applicant was all along on bail during the course of the trial.
3. Having heard the learned Counsel for the parties and having gone through the impugned judgment the following order is passed:
O R D E R
(i) The substantive sentence of imprisonment awarded to the applicant is hereby suspended pending disposal of the appeal, subject to the applicant furnishing a PR bond in the sum of Rs.25,000/- with one solvent surety in the like amount.
CRMA/89/2017 (ii) The applicant shall deposit the amount of fine before the learned Special Judge.
(iii) Bail bonds to be furnished before the learned Special Judge.
(iv) Parties to act on the authenticated copy of this order.
