counsel.

Ms. P. Bhandari, learned Addl. Government Advocate waives service on behalf of respondent no.1.

Upon hearing the learned counsel, we find that only relief sought by the petitioner is to direct the respondent no.1 to expeditiously dispose of Appeal bearing case No. 18-42012/MUT/APL as according to the petitioner, the matter is pending for orders from 03.10.2013.

Mr. Nadkarni, learned Advocate General has pointed out that the respondent no.1 has recently taken charge of the concerned office and in fact has posted the matter for hearing on 09.06.2015. As such as the matter was pending only for orders the new incumbent who has taken charge of the concerned office, would have to hear the concerned parties afresh, it would be appropriate to prepone the said date.

In such circumstances, we find it appropriate and in the interest of justice to direct the respondent no.1 to dispose of the said Appeal No. 18-4-2012/MUT/APL as expeditiously as possible and in any event on or before 31.05.2015.

Needless to say that the respondent no.1 shall issue fresh notice to the concerned parties. Rule stands disposed of accordingly.
