The learned counsel for the petitioner, on instructions, seeks leave to withdraw the petition as the petitioner intends to challenge the impugned order in an appeal under Article 1435 of the Portuguese Civil Procedure Code and/or under Section 451 of the Goa Succession, Special Notaries and Inventory Proceeding Act, 2012. In such circumstances, the petition is disposed of with liberty as prayed. Needless to mention that if the petitioner files an appeal along with an application for condonation of delay the learned District Judge shall pass appropriate orders having regard to section 5 and section 14 of the Limitation Act.
