Shri Jyotiba Shinde appears in person. Mr. S.G. Bhobe appears for the State.

Shri Jyotiba Shinde hands in a praecipe dated 21/01/2021, which reads as follows :

m the applicant in the above-mentioned Writ Petition. As per the guidelines Given to me by this

Hon'ble Court I would like to withdraw this Writ Petition With the permission of this Hon'ble court and to file the same in the lower Court.

I pray before this Hon'ble Court to grant me the permission to reopen or refile the Writ Petition in case I'

m not satisfied or happy with the decision of the Hon'ble Lower Court.

"

The praecipe dated 21/01/2021 is taken on record and marked "X" for the purpose of identification. 4.

Further, Shri Jyotiba Shinde assures this Court that he will step into the witness box in C.C.No.6/S/IPC/2018/C pending before the Judicial Magistrate, First Class, Ponda and depose to his case, without seeking any unnecessary adjournments.

Depending upon the evidence that comes on record, we are quite sure that the learned Judicial Magistrate, First Class at Ponda will take all necessary steps as are available in law.

With the aforesaid observations and liberty, we permit Shri Jyotiba Shinde to withdraw this Petition. We make it clear that such a withdrawal will not prejudice the rights and contentions of any of the parties in the pending proceedings. 7.

This Petition is, accordingly, disposed of in the aforesaid terms.
