P.C:- The Petitioner has challenged the order passed by the Senior Town Planner dated 19 April 2017. By the communication dated 19 April 2017, the Town Planner had refused the building permission pointing out certain lacunas.

The learned Counsel of the Petitioner has sought to address the Court on various issues regarding the points raised by the

It is not possible for us to decide whether the building permission should be granted or not at the first instance, which is the task of the Town Planner. If the Petitioner is of the opinion that the points which are raised by the Officer of Town Planner do not arise, the least the Petitioner could have done before approaching this Court, is to point out to the Town Planner that the grounds which he proposes to advance, once decision is given thereupon, petitioner can pursue his remedies. 3.
If the Petitioner makes a written representation within two weeks from today, the Concerned Department will take a decision thereupon as per law, within a period of eight weeks thereafter. 4.
Writ Petition is accordingly disposed of.
