Heard learned Advocate Shri T. George John for the applicant. The present application is filed for extension of time to surrender the accused to jail authorities by four weeks. It is a matter of record that accused was convicted by the Special Criminal Court / Sessions Judge, North Goa, Panjim. The said conviction was confirmed by this Court. Accused was directed to surrender on 05.02.2021 to serve the sentence. However, the applicant made a request for suspension of sentence. His request was finally heard on

2 902 CRMA 15 of 21 08.02.2021 and came to be rejected. In view thereof, time earlier granted to surrender on 05.02.2021 was extended to 15.02.2021. It appears that in between on the last day of his surrender, he moved an application before this Court and succeeded to get extended the time upto 22.02.2021. Again today, on the last day of the period for surrender, he again moved this application for extension of time to surrender which is nothing but abuse of process of law. True it is he has filed appeal before the Hon'ble Apex Court, as appeared from documents annexed, however, there are number of objections to be removed. In such circumstances, I do not see any reason to extend the time for surrendering himself before the Jail authorities. The accused to surrender as per the order dated 15.02.2021 passed by this Court.
