1. Mr. Somnath Karpe, learned Central Government Standing Counsel for the Petitioner, fairly agrees that the order under challenge is an order of acquittal of the Sessions Judge against the Accused. He submits that an application for leave to Appeal, along with an Appeal against an order of acquittal, will be filed separately and consequently, seeks leave to withdraw the present Criminal Writ petition with liberty to lodge the proceedings to challenge the order of acquittal. Consequently, the petition is dismissed as withdrawn with liberty as 1st July, 2025

WPCR 24 of 2024 prayed for.

2. It is made clear that in case an application for leave to Appeal is filed challenging the order of acquittal, the same shall be subject to limitation.
