Heard the learned counsel for the parties. It is submitted that the parties have amicably settled the dispute and the appellant is not intending to prosecute the second appeal and seeks permission to withdraw the same. In such circumstances, the misc. civil application is allowed.

2. The Second Appeal No.38 of 2011 is dismissed for want of prosecution, with no order as to costs.
