The Petition seeks to challenge the order dated 26.07.2023, rejecting the Application at Exhibit-131 for production of a copy of the agreement dated 21.08.2006 and the photocopy of the certificate of foreign inward remittance dated 27.01.2005.

2. Mr. Godinho, learned Counsel for the Petitioner does not dispute that these documents were in possession, custody and knowledge of the Petitioner as on the date of filing of the written statement by Defendant No. 2, which was filed on 08.08.2023. It is also not disputed that copies of these documents have already been placed on record by Defendant No. 2. Since copies of these documents are already on record, on account of the same been filed by Defendant No. 2, there is no rhyme or reason as to why they should be permitted 18th March, 2024

WP 282 of 2024 to be filed again, as it would be permissible to the Petitioner to take benefit of these documents, which have already been placed on record by Defendant No. 2. I, therefore, do not see any reason to interfere with the impugned order. The Petition is therefore dismissed. AVINASH G. GHAROTE, J.
