1. The agreement dated 03.11.2020 contains an arbitration clause 23, the invocation of which is not disputed by the learned counsel for the Respondent.

2. Both parties are agreeable to appoint Justice R.M.S Khandeparkar, Former Judge of this Court as the Arbitrator, considering which the appointment is so made.

3. The learned Arbitrator is requested to give a declaration in terms of Section 12 of the Arbitration and Conciliation Act. 22nd March, 2024

4. The parties shall appear before the learned Arbitrator on 01.04.2024 and intimate to him regarding his appointment.

5. The application is allowed in the above terms with no order as to cost.
