1. An affidavit of the Applicant was sworn by the duly constituted attorney on 10.04.2025. The same is taken on record. A certified copy of the Power of Attorney of the Applicant in favour of Mohammed Saad Ahmed is taken on record. The certified copy of the Power of Attorney contains an Apostille to certify that the same was executed before the Deputy Secretary of State, State of North Carolina. By the Affidavit, the Applicant withdraws the statement made by her in paragraphs Nos.10 and 12 of her application. Consequently, the application shall be heard along with MCAM No.187 of 2025 (F) after considering that the statements made in paragraph Nos.10 and 12 of the present application are not on record.

It is further recorded that the gold ornaments / personal articles of the Applicant which were in possession of the Respondent, are today handed over by the Respondent to the aforementioned attorney of the applicant, who is present in the Court and who has duly acknowledged receipt of these ornaments /personal articles.

3. The learned Counsel Mr. I Agha, appearing for the Respondent, submits on instructions of the Respondent, who is present in the Court, that the Respondent undertakes to withdraw Marriage Petition No.24/2024/I pending before the First Additional Senior Civil Judge, Margao, by 25.04.2025. It is reported that the concerned Court is presently vacant and without the appointment of a Judicial Official. In the event that such an application for withdrawal of the Marriage Petition is moved, before the in-charge Court, the in-charge Court shall dispose off the petition in terms of the application filed by the Respondent.

4. Acknowledgment receipt of ornaments /personal articles is placed on record. The inventory of the Articles accepted under signature of the Applicant's Power of Attorney with acknowledgment receipt of the inventory is taken on record and marked 'X' for identification. VALMIKI MENEZES, J.
