For the reasons to be separately recorded the following order is passed:

ORDER:

(i) The appeal is allowed.

(ii) The impugned judgment of conviction and sentence is hereby set aside.

(iii) The appellant is acquitted of the offence punishable under

CRIA/52/2017 sections 302, 449 and 397 of I.P.C.

(iv) The appellant be set at liberty forthwith, if not required in connection with any other offence.

(v) Fine if paid shall be refunded.

(vi) The order regarding disposal of property is hereby maintained.
