We are not inclined to entertain the Petition for the simple reason that the very same question will undoubtedly arise in the Appeal. On instructions, Mr Bhobe seeks leave to withdraw the Petition.

The Petition is dismissed as withdrawn. All contentions are expressly kept open. These may also be canvassed before the Assistant Commissioner and other authorities in Appeal. 10th October 2017
