Mr Arun de Sa, learned Counsel for the Petitioner, based on instructions from the Petitioner, seeks leave to withdraw this petition with liberty to file an application for discharge before the competent Sessions Court.

Accordingly, we allow the petitioner to withdraw this petition with liberty as prayed for.

Further, in case the Petitioner files an application for discharge, the competent Sessions Court must dispose of the same as expeditiously as 1st August 2023

We clarify that we have not examined the merits of the matter and all contentions of all parties are explicitly left open to be considered by the competent Sessions Court.
