Heard the learned counsel appearing for the respective parties.

2. A delay of 278 days has occurred in bringing the LRs.of deceased appellant no.1 on record and, therefore, it is prayed for condoning the delay. The delay is caused because the applicant stays in United State of America and, therefore, it took time for him to schedule his visit to India and collect necessary documents such as death certificate of deceased who is said to have expired on 13.7.1995.

3. Sufficient cause has been shown by the applicants for condoning the delay by setting aside abatement to which there is

MCA/438/2016 no objection from the respondents and therefore, in the interest of justice, the delay stands condoned. The applicant shall make necessary amendment to bring LRs of deceased on record within a week. Thereafter, issue notice to the proposed LRs of the deceased respondent, returnable on 7th August, 2017.
