Ms Trupti Nandoskar, learned counsel for the petitioner seeks leave to withdraw the petition. Leave as prayed for is granted and the petition is disposed of as withdrawn with liberty to ile afresh. 2.

It is informed that an appeal has been iled before the Debts Recovery Appellate Tribunal (DRAT) against the DRT's order and the same is pending. here is a stay operating. We therefore clarify that in case of a default or after the matter is decided by the DRAT, it is open for the petitioner to ile a fresh petition for the same reliefs as in this petition. All contentions raised in this petition are kept open. Allowed to be withdrawn with liberty. No costs.
