Heard Mr. P. S. Lotlikar, learned counsel appearing for the petitioner and Ms. P. Bhandari, learned Addl. Government Advocate appearing for respondent nos.1 to 4.

2. Upon hearing the learned counsel, it is not in dispute that the disputed kiosk has already been reconstructed and the petitioner is carrying out business activities therein. Mr. Lotlikar, learned counsel appearing for the petitioner has accepted the said position based on the instructions of the daughter of the petitioner who is present in Court.

3. Taking note of the reliefs sought in the petition, we find that nothing survives in the above Writ Petition. Mr. Lotlikar, learned

WP/148/2009 counsel for the petitioner submits that in case the respondents desire to take any action against the petitioner, such action should be taken in accordance with law. Ms. P. Bhandari, learned Addl. Government Advocate has in fact accepts the said position.

4. Hence, the petition stands dismissed as infructuous. Needless to say that in case any action is taken against the petitioner, such action shall be in accordance with law.
