This application is to condone 167 days delay in bringing legal heirs of respondent no.2(g) on record. The respondent no.2(g) has expired on 18 July, 2013. The petitioner came to know about his death, when a notice issued to respondent no.2(g) returned back on 06/01/2014 with an endorsement that the respondent no.2(g) has expired. For the reasons indicated in the application, the delay of 167 days is condoned. Abatement set aside and application allowed. Amendment be carried out and the amended copy be served upon the respondents.
