After hearing the learned Counsel for the applicant and the learned Additional Public Prosecutor for the respondents for some time, the learned Counsel for the applicant, on instructions, seeks permission to withdraw the application on the ground that since after the filing of the present application, the prosecution has already filed a chargesheet before the Children's Court.

2. It is submitted that when the application was decided by the Children's Court, the chargesheet was not filed. The learned Counsel submits that he will file a fresh application before the Children's Court on the basis of change of circumstances about filing of the chargesheet.

3. In such circumstances, the Criminal Application is disposed of as withdrawn, with liberty to the applicant to approach the Children's Court by filing an application afresh.

4. It is made clear that this Court has not expressed any opinion on the merits of the prayer for bail and the Children's Court shall decide the application, if filed, on its own merits and in accordance with law. C. V. BHADANG, J.
