This petition is filed by the Association of the Higher Secondary Schools Laboratory Assistants being aggrieved by the duties that are assigned to them. The learned counsel for the Petitioners submitted that the Circular dated 15 March 2005, list out certain
2 WP492-18 dt 03-07-2018 duties which are beyond the scope of work of the Laboratory Assistants are supposed to perform. He submits that on the basis of this Circular, the Laboratory Assistants in the aided Schools, are made to perform various duties. The learned Additional Government Advocate pointed out that the Circular is in existence since March, 2005 and the Petitioners' Association is formed in the year 2012. 2.
Considering the lis raised by the Petitioners, we are of the opinion that the issue needs to be first looked at by the State Government as the decision would affect all the Laboratory Assistants working in the aided Schools. We do not have adequate data before us to ascertain whether the duties which are assigned and objected to by the Laboratory Assistants are beyond their scope of work or causes harassment to them or what are the other administrative situations. It is ultimately a matter of administration, which needs to be looked at the first instance by the Authorities.

We, therefore, direct the Director of Education to treat the petition as a representation of the Petitioners and to take a decision thereupon preferably within a period of four months from today. The Director of Education, if required, will call the representative of the Petitioners for discussion to understand the
