Heard Mr. V. Amonkar, learned counsel appearing for the petitioner and Mr. J. J. Mulgaonkar, learned counsel appearing for the respondent.

2. After hearing the matter for some time, the learned counsel sought time to explore the possibility of settlement of the dispute. When the matter was taken up today, Mr. Amonkar, learned counsel appearing for the petitioner and Mr. Mulgaonkar, learned counsel appearing for the respondent have pointed out that in the meanwhile the parties have amicably settled their dispute in connection with the claim put forward by the petitioner in the above petition. It is also pointed out that the parties have executed consent terms disclosing the modality of the repayment of the claim put forward by the

COP/6/2016 petitioner. The consent terms are duly signed by the respective Directors of the petitioner and the respondent as well as their Advocates. The Director of the respondent is also present in Court and admits the execution of the consent terms.

3. Mr. Amonkar, learned counsel appearing for the petitioner has identified the signature of the director of the petitioner and pointed out that the consent terms have been duly executed by the Director of the petitioner.

4. The Director of the respondent who is present in Court undertakes to transfer the amount payable to the petitioner in terms of the consent terms. The undertaking of the Director of the respondent who is stated to be duly authorized to give such undertaking is accepted. The first instalment of the amount will be paid to the petitioner in terms of the consent terms during the course of the day. The consent terms are accepted and marked 'X' for identification.

5. The petition stands disposed of in terms of the consent terms marked 'X' for identification.
