On 2 nd August, 2019, the following order was made : "Heard the learned counsel for the parties.
2. In furtherance of earlier order dated 26th July, 2019, the learned counsel for the parties now state that they are agreeable to the appointment of the Hon'ble Mr. Justice N. A. Britto, retired Judge of this Court as Arbitrator in the dispute between the parties. They state that they will place this order before the Hon'ble Mr. Justice N. A. Britto, so that, the learned Judge, can submit a statement of disclosure as is required under the provisions of the Arbitration and Conciliation Act, 1996 as amended.

3. The learned counsel for the parties point out that the matter may be adjourned by two weeks in order to do the needful in this regard. Accordingly, stand over to 16th August, 2019.

Today, the learned Counsel for the parties submit that Hon'ble Mr. Justice N.A. Britto is agreeable to be appointed as Arbitrator in the matter and further they also place on record the disclosure statement made by Hon'ble Mr. Justice N.A. Britto, retired Judge of this Court.
The statement is taken on record.

Accordingly, with the consent of the learned Counsel for the parties, Hon'ble Mr. Justice N.A. Britto is appointed as Arbitrator to arbitrate into the disputes between the parties. It is made clear that all contentions of all the parties are specifically kept open for the decision of the learned Arbitrator.

The learned Counsel for the parties state that there is no necessity of making any specific orders in relation to the fees to be paid to the learned Arbitrator, since, now these matters are governed by the provisions of the Arbitration and Conciliation Act, 1996 and Rules made in that regard.

Accordingly, the Application for Appointment of Arbitrator, is disposed of.
