Heard the applicant in person and Shri J. A. Lobo, the learned counsel appearing for the respondent no.1.

2. This is an application to recall the order dated 28/2/2017 passed by this Court extending the time to complete the inquiry within four months from the date of the order.

3. Upon hearing the party in person and Shri. Lobo, the learned counsel appearing for the original respondent no.3, we find that the extension sought by the inquiry officer which was filed

MCA/349/2017 somewhere in September 2016 was seeking an extension of four months to complete the inquiry. But, however the matter came on board only on 28/2/2017, when the extension was granted without notice to the parties. In the peculiar facts and circumstances of the case and without going into the rival contentions and in the interest of justice, we find it appropriate to direct the Inquiry Officer to complete the inquiry as per the directions reflected in the order dated 28/2/2017 on or before 31/5/2017.
