Heard Mr. P. Kamat, learned counsel appearing for the petitioner and Mr. Faldesai, learned Additional Government Advocate appearing for the respondents.
2. Upon hearing the learned counsel appearing for the petitioner, it appears that the grievance of the petitioner is that though permission has been obtained from the Public Works Department by letter dated 14th March, 2016 to dig the road to lay a water pipeline which is valid for 15 days, the work cannot be carried out, as the petitioner apprehends law and order situation problem while carrying out such exercise. It cannot be disputed that maintaining law and order is the duty of the State and in such circumstances, to avoid any such problems a person has to be given assistance when required. The learned AGA also does not dispute that the said permission granted
WP/330/2016 by P.W.D. is still in operation and is valid. Accordingly, the respondents shall provide the police assistance in accordance with law, if required, at the costs of the petitioner, to comply with the said subsisting permission of the Public Works Department dated 14th March, 2016 to dig the concerned road to lay the pipeline.
