Both the learned Advocates submit that the appeal could be disposed off with a direction to the Trial Court to expedite the hearing and dispose off the proceedings without being influenced by the observations made in the impugned order as well as the order dated 05.05.2006 passed by this Court in the said appeal.

In view thereof, the amount ordered to be deposited pursuant to the said order, shall be transferred to the account of the Senior Civil Judge, North Goa, Panaji. The Trial Court to invest the amount of ₹1,50,000/- in a fixed deposit of any Nationalised Bank. The Trial Court is

directed to expedite the hearing in the suit and to dispose off the same within a year from today.

The stay granted pursuant to the order dated 05.05.2006 is confirmed.

Registry to inform the Trial Court accordingly. Appeal stands disposed off.
