It was the contention of Shri Kapil Kerkar, learned Advocate for the applicant that a substantial part of the trial has been completed and only two witnesses remain to be examined being the Investigating Officer and the decoy customer. However, the trial is not progressing before the learned Trial Court and therefore he prays for bail. It was also his contention that earlier the applicant was enlarged on bail but due to some misunderstanding he was not appearing in the Court and which ultimately led to his arrest for which he is in detention since

crmab no.80 of 2019 21/12/2018.

3. Shri S.R. Rivankar, learned Public Prosecutor for the respondents in fairness conceded that only two witnesses remain to be examined and that considering that the applicant was earlier enlarged on bail, there is no serious objection to he being enlarged on bail again, provided certain conditions are imposed to ensure his presence before the Court. 4.

In view thereof, the applicant is enlarged on bail on executing a bail bond in the amount of ₹25,000/- and furnishing one local surety to the satisfaction of the learned Additional Sessions Judge-1, Panaji. He shall regularly appear before the Trial Court and not absent himself till the conclusion of the trial. The Trial Court is directed to expedite the trial and to conclude the same within two months from today.
